Registration of Trusts

  • To register a revocable living trust, the trustee must file a statement with the court where the trustee resides or keeps trust records. The statement must include the name and address of the trustee, and acknowledgement of the trusteeship.

Deceased Estates & Insolvent Estate Transfers

  • A deceased estate comes into existence when a person dies leaving the property or a document that is a will or purports to be a will. Such estate must then be administered and distributed in terms of the deceased's will or failing a valid will, in terms of the Intestate Succession Act.

  • If your deceased estate turns out to be insolvent, and you have nominated a beneficiary, the proceeds of the policy will not fall into your insolvent estate but will be paid directly by the insurer to the nominated beneficiary.
